With the fight over abortion rights looming large over the midterm elections, voters in Florida ousted two prominent anti-abortion elected officials in separate races on Tuesday.
Florida Rep. James Bush lost his reelection bid, a notable defeat for the sole Democrat in the state legislature who voted on a 15-week abortion ban and the anti-LGBTQ "Don't Say Gay" bill.
His opponent, 37-year-old lawyer Ashley Gantt, ran on a platform focused on affordable housing, public education, and criminal justice reform. Gantt, an attorney and former public school teacher, has criticized Bush for siding with Republicans on the abortion ban and the "Don't Say Gay" bill, which bars "classroom discussion about sexual orientation or gender identity."
"As a Black woman, I was offended when he voted to restrict my rights, our right to make decisions over our bodies," she said last week. "As a former teacher, I was insulted that he voted to inject Tallahassee extremism into our classrooms and deny local control over our school systems."
Gantt and Bush were the only two candidates vying for District 109. As the winner of the Democratic primary, Gantt is now the representative-elect.
Bush was first elected to the Florida state House in 1992. He was elected again in 2008, then in 2018. His penchant for supporting Republican-sponsored bills drew the ire of his fellow Democrats, some of whom publicly voiced their support for Gantt in the election; Democratic state Sen. Jason Pizzo recently accused him of "voting against Democratic values and kissing the Governor’s ass - all day, everyday."
Florida voters also ousted Jared Smith, an incumbent circuit judge for Hillsborough County who gained notoriety for rejecting a teenager's request for an abortion because her grades were low.
The race between Smith and his opponent, Nancy Jacobs, was relatively contentious for a typically low-key nonpartisan judgeship election, the Tampa Bay Times reported.
Smith had denied a 17-year-old seeking an abortion without parental consent in January this year on the basis that her grades were low and that she lacked "intelligence or credibility," and was therefore not mature enough to get an abortion. An appeals court later overturned his ruling.
Jacobs did not directly criticize Smith over his decision (Florida bars judicial candidates from making public statements on legal issues), but she has shared posts on Facebook regarding the ruling.
In a statement to BuzzFeed News, Jacobs said she looked forward to taking the bench in January and "ensuring that the people of Hillsborough County who enter my courtroom are treated with respect, dignity, and integrity every day."
She said that Smith's decision in the abortion case was possibly "one factor among many in voters’ decisions on whom to cast their ballots for in this race" given that it made national headlines.
Smith had made his Christian faith central to his reelection campaign. His wife, Suzette Smith, once told supporters that Jacobs, who is Jewish, "needs Jesus."
"We pray for her. She needs Jesus," Suzette Smith said. "To deny God and to deny the Bible is a person that’s — the heart is very hard toward God.”
Jacobs called the comments "troubling" and accused the couple of "using their religion to insult and disparage the faith of an opposing candidate."
Florida is set up for a riveting general election in November, with abortion rights expected to be a central issue in races all the way up to the gubernatorial election.
Charlie Crist, a former Republican governor, won the Democratic primary on Tuesday, setting up a challenge against Gov. Ron DeSantis. Crist fended off accusations of being "pro-life" from his primary opponent, Nikki Fried, arguing that he struck down anti-abortion bills during his time in office.

Backstory: Born to a reformed criminal turned lawyer, Emilio grew up in Tampa, Florida, and was raised by his father, Enrique, who served in the state attorney office of the city. They appeared to be arguing as the hurricane became more violent so did the body language of those women. To his surprise, they all pointed in his direction and he ran to his father as he was in the middle of going over a case. Comforting his son, Enrique assured Emilio he was safe and that his eyes were playing tricks on him. Eventually, the young boy would peer into the veil that was the Mist and question what happened during that storm and why one of the women stared at him with a mix of pain, contempt, and something else...

..."In August 2022, the Republican governor suspended Hillsborough County State Attorney Andrew Warren, complaining that the local prosecutor wasn’t prosecuting the kind of culture war cases DeSantis wanted to see.
A Tampa Bay Times report noted at the time that DeSantis’ order suspending the state attorney did not cite “any specific examples of Warren not prosecuting individual cases, pointing instead to Warren’s public comments on abortion, transgender issues and office policies Warren has adopted.”
The newspaper’s editorial board added that the governor’s move was “politically craven, legally suspect, suspiciously timed and odorously soaked in autocracy, partisanship and bad faith.” Under a headline that reminded DeSantis that he isn’t “the king of Florida,” the Times went on to characterize the suspension as a “gross abuse of power.”
The criticisms were well grounded. DeSantis had already been accused of authoritarian pursuits, and this didn’t help matters. The people of Hillsborough County elected Warren more than once. The governor could’ve tried to help elect a rival candidate in the next election, but instead, DeSantis took it upon himself to suspend the prosecutor and install someone else that he preferred.
In effect, the Republican told Hillsborough County voters, “Sure, you may have chosen a state attorney through the democratic process, but I think I know better.”
Making matters worse, an earlier New York Times report noted while DeSantis said his move against Warren was necessary in the interests of “public safety,” the claim was completely baseless: “Mr. DeSantis and his advisers had failed to find a connection between Mr. Warren’s policies and public safety in his community.”
In fact, the Times added that the Republican’s lawyers lamented the fact that they couldn’t find anything in the local crime statistics to justify the local prosecutor’s suspension."
DeSantis suspended the state attorney anyway. The point, by all appearances, was to give the governor something else to brag about on the presidential campaign trail — a concern that was soon confirmed when the Floridian started boasting to Iowans about ousting the progressive state prosecutor.
But DeSantis did not have the final word on the subject. The 11th Circuit took a closer look and concluded what was plainly true: The governor targeted Warren for political purposes based on comments the prosecutor made about major issues of the day.
The matter is now headed back to a lower court, but in the meantime, it’s worth pausing to appreciate just how frequently the GOP governor’s culture war efforts have struggled in the courts. Last summer, for example, DeSantis’ policies against drag shows and trans care have suffered legal setbacks, which were part of a lengthy pattern.
DeSantis also lost when a court blocked Florida’s “Stop WOKE Act”; his anti-protest measure was also blocked by a federal judge; the Republican’s law to regulate social media companies was blocked by a different federal judge; and the cases brought by his elections police unit have largely fallen short."
