Reducing Road Accidents and Driving Tips

Road accidents have been part of man’s existence ever since he discovered he can travel using the wheel. Reducing road accidents is possible though. In the past, there were fewer road accidents because there were fewer cars on the road.

Accidents and fatalities are almost in proportion to the increase in population and the number of vehicles. The United States for example, with a population of 76 million in 1900 had a total number of 36 registered road accident fatalities while in 2016 there was a total of 37,806 registered fatalities from a population of 323 million.

But reducing road accidents isn’t as difficult as you imagine. As mentioned, fatalities and injuries are said to be almost in proportion to the population. Because in 1972, there were a total of 54,589 casualties from a population of almost 210 million, much more than the number of fatalities last 2018 that numbered 36,560.

With that example, one can say that the United States has a somewhat working safety program which greatly reduced the numbers from the 1970s. There are of course many factors as the numbers for the past decade fluctuated up and down between 32,000 and 38,000.

Awareness is the best weapon against any type of incident, including road accidents. Any sensible government in the world should be posting or airing content such as public service announcements (PSAs) or tips regarding road safety.

Reducing Road Accident Tips

Keeping both eyes on the road while driving – it’s a clear given that the driver must keep both eyes on the road at all times though it’s important for the driver to glance on the side and rear mirrors every ten seconds or so.

Avoiding driving while intoxicated – Don’t drink and drive.

Following speed limits

Never use your cellphone – in line with the first rule. Drivers should not be too distracted while driving.

Following traffic signs

Ignoring aggressive drivers

Lack of driving knowledge – drivers should at least know the basics of their vehicles as well as traffic rules and signals.

When Is a Misdiagnosis a Malpractice Case?

Misdiagnosis malpractice cases can be a little tricky. Misdiagnosis can happen frequently especially for diseases that are rare. As some rare diseases can have symptoms that are as common as as the common cold. For example, someone who doesn’t know they have SARS, Leptospirosis or Lyme disease could simply receive cold or flu medication especially during an actual cold season. To be considered a medical malpractice, the misdiagnosis or the failure to diagnose must be proven to have resulted in more harm to the patient due to delayed treatment, mistreatment or no treatment at all. Because diagnostic errors are pretty common (and why the practice of getting a second opinion is so prevalent), not all misdiagnosis malpractice cases result in a successful lawsuit.

For misdiagnosis malpractice cases to be successful, plaintiffs need to prove several things:

That the doctor failed to live up to the standard of care depending on their specialties or even in general medicine terms. It may be a simple or routine diagnosis that another doctor of the same discipline would have easily detected. The physician in question must be in the right specialty. For example, the patient cannot consult a doctor of general family medicine for diabetes complications.

That a doctor-patient rapport was evident and not a simple one-off casual encounter.

That the doctor in question did not perform all the diagnostics in a checklist that he/she is fully aware of, thus not getting all the vital information.

That a faulty lab test result has occurred due to faulty equipment and/or human error. This involves not just the physician, but the hospital or clinic as well in a misdiagnosis malpractice case.

That the condition has actually worsened due to the misdiagnosis as opposed to maintaining a status quo. This is where the prescribed medication had no effect at all. A successful misdiagnosis malpractice case, for example, could be the failure to diagnose a cancer or the proper stage that it’s in.

That there is a failure by the physician to refer another doctor or specialist, if the symptoms being treated show no improvement. Or that there was a failure to recommend screening for any other suspected medical condition.

Commonly misdiagnosed conditions

To avoid having to pursue any misdiagnosis malpractice cases, it’s prudent to be aware of some medical conditions that can easily be misdiagnosed. And which the doctor could be made aware of ahead of time.

Cancer can be commonly misdiagnosed as symptoms could easily be mistaken for other conditions depending which organ is affected.

Heart attack could be mistaken for a panic attack, indigestion or GERD.

Lymph node inflammation could be misdiagnosed as appendicitis.

Asthma could be misdiagnosed for bronchitis.

A staphylococcus infection could be mistaken for the flu.

A stroke could be mistaken for something else in younger patients as the possibility is minimal, but possible.

What is a Wrongful Death Claim?

The death of a person can be caused by many things, directly or indirectly. When a death is caused indirectly, let’s say by a road accident, it can be attributed to the negligence of another driver or the person/company in charge or road maintenance. The victim would not have died if not for the circumstances directly/indirectly caused by the persons involved. The relatives of the victim can then file a wrongful death claim on said persons or entities.

In the United States, a wrongful death claim can be filed by relatives when a person or entity is the cause of a person’s death either through intentional action or negligence. Relatives, the person’s estate or those close to the deceased can file claim for the potential earnings of the deceased lifetime or a survival amount on behalf of the deceased person’s beneficiaries which include funeral expenses, as well as punitive and emotional damages.

In wrongful death claims, burden of proof to provide contrary evidence is given to the defendant while the plaintiff is initially given the benefit of doubt but must also provide the same evidence that the deceased would have provided. It must be proven that the defendant breached or neglected his/her duties and such negligence was directly or approximately the cause of the death of the victim. It must also be proven that the victim’s death is the cause of the damages the plaintiff is suing for. Wrongful death claim statutes however differ from state to state but the concept remains the same.

Wrongful death claims may be filed usually by the victim’s estate or immediate family. In the United States, the plaintiff allowed may vary from state to state. Universally, the victim’s spouse is allowed to file a claim as well as parents of minors, but states differ when it comes to other familial relationships.

What can be claimed include survival claims, medical costs prior to death, funeral and burial costs, loss of inheritance, and loss of love, care and nurturing the victim would have provided. A value equivalent to the services that would have been provided by the deceased or the deceased expected income could be claimed.

One famous case of a wrongful death claim is the case between Michael Jackson’s family versus the then King of Pop’s concert promoter AEG. AEG is being blamed by the Jackson family for indirectly causing the death of the King of Pop who overdosed on the sleeping pill Propofol. It was administered by convicted physician, Dr. Conrad Murray, who was hired by AEG. Michael Jackson was having difficulties sleeping and Dr. Murray was tasked to take care for Jackson and make sure he would be able to fulfill his concert obligations. Murray was eventually convicted, but the court couldn’t find proof that AEG pressured the doctor to make sure Jackson completed his concerts. Thus AEG is cleared of any liability.

Another popular case is the OJ Simpson murder trial where the family of Simpson’s wife, Nicole Brown, filed a wrongful death claim against the actor, a suit which is separate from OJ’s criminal case. In murder cases, the plaintiffs can sue for damages apart from murder or homicide charges against the accused.

The first diagnosis of asbestosis was made in the UK in 1924 when sharp microscopic asbestos particles were discovered in the victim’s lungs. Despite the known dangers of asbestos, it wasn’t until 2003 that it was banned entirely by developed countries, though asbestos remains legal in the United States.

However, many other countries continue to mine and use the material despite the health risk. Russia continues to mine asbestos and produced about a million metric tons alone in 2015. As mentioned, asbestos was as ubiquitous and as flexible as plastic is today. The main difference to plastic is that asbestos is fireproof which makes it an ideal building material. Resistance to fire is the material’s claim to fame, plus asbestos’ flexibility allows manufacturers to make affordable, durable, thin, lightweight and fireproof construction materials such as asbestos siding, piping and shingles. Asbestos siding for example is made by mixing asbestos with Portland cement. Asbestos makes the cement lightweight, durable and flexible enough to be made into thin constructs of various shapes such as piping and roof tiles. Fabrics lined with asbestos is still in use by firemen in some countries.

Many buildings constructed with asbestos remain in use today and their deterioration causes the release of asbestos particles in the air. Cracks in the walls, ceilings and floors must be carefully inspected and when such happens needs to be carefully removed.

Currently, the dangers of asbestos siding are mainly during the cutting process as manufacturers hold their products in high regard. Asbestos particles are only released during cutting and breaking and workers are susceptible without the proper safety gear. Residents also become susceptible if the finished structure isn’t properly treated.

The most dangerous aspect of asbestos poisoning is that it isn’t immediately apparent. Symptoms could take from 10 to 30 years to develop and can easily be misdiagnosed. This treachery of diseases caused by asbestos is why developing countries prefer not to take chances and banned the material entirely.
