You're inside of a building. The building is on fire.

Inside of the building there is also an incubator containing a fertilized human embryo. The incubator is advanced enough that, given enough time, we can reliably say the embryo will develop into a healthy infant the same way it would if it were inside of a human womb. The backup power on the incubator is sufficient that you know the embryo will survive if you take it with you.

On the other side of the building you know that there is a 4 year old child who is alone.

Given that the building is on fire, the child's location on the other side of the building, and the complexities of removing the incubator from its power source, you either have time to save the embryo or time to save the child, but you do not have time to save them both.

Now, are there any lingering questions as to how we "know" whether an embryo is a person?
