David Stuart Davies:
Regarding 'The Norwood Builder', Michael Cox and Jeremy Brett had a long, hard discussion about the part of the script where Holmes disguises himself when he hides in the woods and meets a tramp. It really wasn't much of a disguise as such: there was no false nose, wig or other artificial aids. All we got was Jeremy in mufti, with unkempt hair and a dirty face.
Michael Cox recalls:
'Jeremy said, "Holmes was taken unawares and would not have his make-up with him out at Norwood, Michael." So what he decided he would do is wash the gunge out of his hair and do a sort of country accent and play him as a totally different person but not someone who looks startlingly different. Frankly, I was a bit disappointed. I wanted him to do something more exotic. But I can see the logic of his position. So we went with Jeremy on that.'
It is a case of Brett being true to Holmes and the situation, but, I suspect, the viewing public would be on Michael's side on this issue. It would have been far more satisfying to see him buried beneath some glorious concoction rather than the grubby, real Brett that we got.

okay so as we all know, mason and corey are canonically dating, and i think with time and development we’ve all collectively agreed that liam and theo would too.
Tumblr media
liam and corey seemed to not like each other very much, and only got along for mason’s sake, which was sweet on their part but yk they’re kinda frenemies as of right now.
mason is still definitely holding a bit of a grudge against theo, and although that may have been exacerbated by the anuk-ite, he still clearly has hurt feelings. i also personally see mason as the type to be protective about his friends & bf so i think he probably doesn’t wanna give theo a chance because he hurt them so much. and that’s totally valid.
with time i think they’d all get to be better friends, but it’d take time obv. you can’t rush redemption.
Tumblr media
and so we know that mason and liam are best friends (and have one of my favourite friendship dynamics on the show i love them so much) so where does that leave theo and corey?
glad you asked. or i’m assuming you asked. idk.
they don’t interact after season 5, and although corey has been very traumatized by theo, i think corey is the most logical and unbiased out of his trio w liam and mason. like, if they ended up needing theo to defeat something, i think he’d be quick to defend liam & say yea we kinda need theo to do x thing or whatever.
they’d both have to work through stuff. theo’s also been in traumatic situations with corey, he probably has a lot of repressed regret about killing the other chimeras too, but i honestly think they could be really good friends after good and gradual development.
like they both had really bad childhoods! really bad childhood solidarity
plus it would just complete the grid and that would be satisfying okay
where does that leave hayden & the others??? brett crashes their double dates (i got this hc from a friend, thanks devon,) hayden is sometimes the only one with a braincell when theo and mason aren’t using it, and nolan,, idk where nolan goes he’s somewhere
also liam and hayden are really good friends who make fun of each other, almost like siblings, and you can pry that headcanon from my cold dead hands

I have literally no clue how to do this, but director’s commentary on your ‘One expensive can of easy cheese’ fic?
hell yeah!!
all comments will be in bold
______
Race was sat on top of the counter in his and Albert’s apartment, race only knows how to sit on counters lets be real, he can't sit in a chair to save his life a piece of duct tape over his mouth and his hands tied together with kitchen twine KINKYY. He sighed against his restraints, resigned to watch his boyfriend make their contribution to this year’s Thanksgiving gathering: mac and cheese. okay so its mac and cheese cause if you read spies mac and cheese is Literally the Only thing albert knows how to cook, other than coffee, and he's Really Fuckin Good At It (he's the mikey of mac and cheese okay this is my hc)
Now, of course everyone and their mother knew that mac and cheese was not a Traditional Thanksgiving Food is it though, r a c e r?. But, Albert had won (best out of three) mario kart yesterday so he had gotten to decide what they would bring to Jack’s house i was gonna make it rock paper scissors, i do not know hot to play mariokart, but it sounds more heated than rock paper scissors. Had Race known that he had been planning to make mac and fucking cheese, maybe he would have tried a little harder race be quiet you literally love alberts mac and cheese its a known fact.
Apparently, Albert was not pleased with Race’s reaction to his decision to make mac and cheese, and thought that Race might try to get in the way somehow (which he may or may not have fully intended to do) he did. So he did what any loving boyfriend would: sat him on the counter, put duct tape over his mouth and tied his hands together so he wouldn’t interfere albert sounds real kinky in this, why did i make this so kinky, wait when did i even write this.
Race was beginning to wonder why he had agreed to move in with Albert in the first place. CAUSE YOU LOVE HIM THATS WHY
With a violent shake of his head and one final spat who the fuck uses the word spat huh saph??, he was able to dislodge the duct tape d i s l o d g e thats some karen bs right there.
“Albieeeeee,” he whined, laying down on the counter. “Can you pleaaaaaaaseee let me helllllllllp?” yeah albert let him help jeez he's the one who actually knows how to cook
Albert barely glanced up as he pulled the big wooden spoon out of the pot and gave it a thoughtful lick note to self, all licks should always be thoughtful. “Hmmmmmmm. No.” dumbass. if only you knew what was coming.
“But-!” He wriggled w r i g g l e d around to give Albert his best puppy dog eyes. “Can I make something else then? Ple-OW!” He glared at the spatula that had been hurled at his arm. “You apologize for that!” damn albie why so mean? o wait i wrote this wait...
“Nah.” He smirked and went back to stirring his wretched pasta okay but i did a good job making race salty i gotta give myself that. Well, actually Albert’s mac and cheese was quite good hELL YEAH IT IS. Race was just salty that he was making it for Thanksgiving when it was very well known that he was the chef of the two and Jack was expecting something good not the mac and cheese Albert famously made at 2am in college when they were all high as hell. okay real talk tho, no one eats good mac and cheese in college, its the instant microwave shit cause were all broke so thats a lie race
“Can you at least untie me then?” ;)
“No.” Albert even bother considering this time. albert this is gettin Real Kinky..
“Well.” If logic wasn't going to work on Albert he would have to try another method. “I know you know how to make a guy feel good Albie HAH YES I KNEW I PULLED SOMETHING WEIRD, but I never expected ropes to be a part of it. What’s next? Handcuffs? Whips? Chains?” i gotta tell ya life without ya has been hard. hard? has been bad. bad? has been r o u g h. k i N kY
In two seconds flat Race was out of his kitchen twine bonds and flexing his sore wrists. LIKE HECK HE WAS CAUSE ALBERTS ACE AND HE DONT WANT THAT REPUTATION!!!
“Man Albie, who knew you had a twine kink.” hehe u go race
“You know,” Albert began loudly, as if thinking that his loudness would cover up his totally obvious twine kink yeah albie has a twine kink, he licks it, no this is a joke, “if you want to do something that's actually useful, you could go to Walgreens and buy me another can of Easy Cheese.” W A L G R E E NS. this whole fit was an excuse to write another part of the walgreens au
“Is that what you put in your fuckin mac and cheese?” Race swore he actually felt bile rise in the back of his throat when Albert nodded. “That’s it. I’m never eating your mac and cheese again.” BUT YOU LIKE IT
“But-!”
“I’ll eat you though,” Race winked, taking a moment to enjoy the startled, yet somehow pleased look on his boyfriend’s face. okay maybe albert wasn't ace in this particular fic...
“Not until after we’re done at Jack’s.” yeah definitely not scratch that. i write a lot of fics. Albert said only half jokingly as he dug around in his pocket for a second before throwing a crumpled five at Race. “In the meantime though, be gone thot!” GO AWAYYYY. IM A MAN OF GOD. mikey and my sister have subjected me to too many tik toks im sorry
Race barely managed to catch the bill without falling on the floor, but still blew a kiss to Albert before walking out of the apartment.
Who the fuck puts easy cheese in mac and cheese? albert does. but its actually a plot point just to get you to walgreens and if anyone puts easy cheese in mac and cheese i will fite you. He wondered for the millionth time as he stomped the three blocks to Walgreens. Albert claimed that he had chosen his apartment for its proximity to the store he did, actually, but up until today Race had always assumed that he had been joking he was not. The man did make a lot of mac and cheese and if Easy Cheese was an ingredient well….maybe there was some truth to that story after all. you can buy easy cheese at a lot of places tho...i don't actually know if you can buy easy cheese at a walgreens
Race pulled open the door to the Walgreens, pausing briefly to wonder why the absolute fuck it was open on literal Thanksgiving before remembering that it was a fucking Walgreens and why wouldn’t it be open to sell his dumbass boyfriend a can of fucking Easy Cheese. walgreens remains a mystery indeed. my only experience was the one that my best friend and i would go to at lunch during senior year. also have you ever noticed that most walgreenses are on corners? cause their slogan is at the corner of happy and healthy??
In order to get to the Easy Cheese, or at least he assumed so because he had never bought a can of Easy Cheese in his whole glorious 25 years of life a true chef, Race had to walk past the Pharmacy section of the store. And, it just so happened that there was a guy sitting behind the counter at the Pharmacy. A very attractive guy. With a beard. In scrubs. oh my god the most questionable villain I've ever written.
Now, of course Race loved Albert and nothing would ever change that, but he could appreciate an attractive man when he saw one indeed he could. He thanked whatever deity was out there for the bit of man candy M AN C AN D Y that he had been granted and went in search of his Easy Cheese. oh just you wait racetrack
“Mac and cheese, velveta cheese, microwaveable mac and cheese, where the fuck is the- oh thank fuck there we go.” my best friend and i spent much time looking at the mac and cheese in walgreens He pulled a can of Easy Cheese off of the shelf, tossing it once and catching it athletics before turning to go pay for the horrendous product, happy to finally be done with the whole ordeal when- B R E T T
“Easy cheese? Really?”
Race whirled whirled? saph please get a better vocabulary around to see Mr. Man Candy hA himself leaning against the opposite shelf. “Wh- who?”
“Oh,” he dusted his hand off on his scrubbs oh my god Wait i wrote this cause one time when i was in a walgreens i Did see a hot dude working the pharmacy and decided to write a fic about it!! i remember texting mikey about this hjfhgjhg, “allow me to introduce myself. My name is Brett O’Hare. and mikey came up with that name And you, sir, are a disgrace to society. The very reason why so many Americans are in poor health in this day and age.” brett is an obnoxious millennial in case you can't tell
“I’m sorry, what?”
“The Easy Cheese!” Brett gestured wildly toward the can in Race’s hand. “Gosh do you even know how many preservatives are in that stuff? And all the cancers that it can cause? It’s terrible. We wouldn’t need free healthcare if people just stopped eating Easy Cheese!” apparently he's a millennial who's also a republican...?
Race had lived in New York City his whole life, and he had seen some pretty strange things subway pizza rat, but never had he seen a pharmacist in a Walgreens lecture anyone about the health benefits of Easy Cheese. easy cheese has no health benefits. and if you'd stopped annoying your boyfriend maybe you wouldn't be there
“So let me get this straight,” Race rubbed his head, trying to make sense of the situation. “You go around yelling at people about the ingredients in the things that they are purchasing?” yeah its nyc people love to have Opinions. and so do millennials
“Yeah.”
“You do realize that this is a Walgreens, right? Everything in here probably contains some kind of chemical.” man brett has his work cut out for him. New Yorkers never ceased to amaze him.
“All the more reason for me to inform them of their poor eating habits!” Brett pointed a finger at him. “And stop distracting me! You’re the one buying the freaking easy cheese here!” this is so weird why did i come up with this idea. what possessed me.
“It’s not even for me!” Race shouted back. “It’s for my boyfriend’s fucking mac and cheese that he insisted on making for Thanksgiving even though everyone knows that mac and cheese is not a fucking Thanksgiving food and he’s only making it cause he knocked me off the goddamn rainbow road right before the fucking finish line!” someones salty Race was fuming but the time that he was done.
“Oh, man I’m so sorry, that's lousy.” but it won't stop brett...
Race looked surprised. Of all the things that he thought he would get out of this Walgreens experience, a therapy session was indeed not on the list. But neither had been hearing a lecture about the preservatives in Easy Cheese from a pharmacist. i have literally no explanation for this train wreck of a fic
“But that doesn’t change the fact that you’re still buying Easy Cheese!” Between one second and the next, Brett had grabbed the can of Easy Cheese out of Race’s hand, wielding it like a brick ha percy jackson heroes of olympus anyone??. “Buy some fucking vegetables!” you can't buy vegetables in a walgreens brett
And with that, he struck Race over the head with the can of Easy Cheese.
Now, Race had definitely done some questionable things during his life Thats for sure. Once he had slept on the roof of his dorm building in January for a week because he lost his dorm key god why you can't even get on the roof of dorm buildings i know, I've tried, and another time he had been tricked into making an entire wedding cake using salt by Who??. However, being smacked over the head with a can of Easy Cheese by a health nut in scrubs on Thanksgiving put any and all other situations he had been in to shame in a walgreens don't forget. how did you forget that saph.
He opened his eyes, suddenly blinded by the lights, and reached for his phone, muttering curses about man candy and vegetables as he should be. Squinting so he didn’t have to look at the screen, he somehow managed to dial Albert. no one d i a l s anyone saph. its the 21st century. i have like maybe 8 phone numbers memorized, half of them belong to my family the other half to people i knew in middle school.
“Racetrack Higgins, where is my Easy Cheese?”
Race pulled the phone away from his ear and winced at the sound of his boyfriend’s voice. “Um, it may have been used to give me a concussion by a health nut in scrubs?” for Once al isn't the one who gets injured in a walgreens. bet you didnt see That coming
Albert let out a loud sigh. “Ah man, did you run into Brett? That guy’s the worst.” hehe bet al used to date him
“Wait, you know him?”
“Race, I know every Walgreens employee in Manhattan, of course I know Brett.” There was the jangling of keys in the background. “I thought I told you to go to the one on 4th for this reason, ah, well. I’m on my way. I’ll take you to urgent care. Hang tight.” ofc al goes to urgent care. and everyone there knows him by a first name basis
Race’s head hurt too much to process what Albert had said except for the words ‘I’m on my way.’ “Okay,” he sighed. this was definitely one of the times i asked mikey about oddly specific concussion symptoms and then proceeded to forget everything he told me and do my own stuff
“Love you.”
“Love you too.” Race’s eyes focused on the dented can of Easy Cheese rolling on the floor he should still buy it. “And Al?”
“Yeah?”
“This is going to be one expensive can of Easy Cheese.” get it? cause race has to pay urgent care for his consultation? and they're also Very Very late to thanksgiving. cause al insists on finishing his mac. jack is not impressed. he eats all races pie.
anyway thats that hope you enjoyed

From the report by Matt Ford, posted 27 Oct 2020:
In shadow docket cases, unlike normal cases, there is no written opinion summarizing the views of the majority. Their reasoning must instead be synthesized from any concurring opinions written by those justices, if they exist.
Chief Justice John Roberts briefly argued that the court was justified to intervene when a federal court changed state election laws but not when a state supreme court did so, thus explaining his vote in the Pennsylvania election case earlier this month (when he voted with the three liberal justices to allow the state to count all ballots received by November 6). Justice Neil Gorsuch critiqued the lower court for imposing its own rules on Wisconsin because of the pandemic when state officials had already made significant accommodations.
Kavanaugh largely agreed with Gorsuch’s reasoning but added to it by explaining why he thought state ballot deadlines were sacrosanct.
“For important reasons, most States, including Wisconsin, require absentee ballots to be received by election day, not just mailed by election day,” Kavanaugh wrote. “Those States want to avoid the chaos and suspicions of impropriety that can ensue if thousands of absentee ballots flow in after election day and potentially flip the results of an election. And those States also want to be able to definitively announce the results of the election on election night, or as soon as possible thereafter. Moreover, particularly in a Presidential election, counting all the votes quickly can help the State promptly resolve any disputes, address any need for recounts, and begin the process of canvassing and certifying the election results in an expeditious manner.”
This is not how American elections work, and it’s profoundly embarrassing for a Supreme Court justice to claim otherwise.
States do not “definitively announce” results on an election night; news organizations like the Associated Press issue projections that are often correct but not legally binding. In arguing for mail-in ballots to be tossed, Kavanaugh prioritized the perception of election results over the results themselves. “There are no results to ‘flip’ until all valid votes are counted,” Justice Elena Kagan wrote in her dissent from the court’s order. “And nothing could be more ‘suspicious’ or ‘improper’ than refusing to tally votes once the clock strikes 12 on election night. To suggest otherwise, especially in these fractious times, is to disserve the electoral process.”
Kavanaugh’s argument here amounted to little more than lending a judicial imprimatur to Trump’s own efforts to delegitimize election results that might not reflect him as the winner.
“It would be very very proper and very nice if a winner were declared on November 3, instead of counting ballots for two weeks, which is totally inappropriate and I don’t believe that that’s by our laws,” [Pres.Trump] told reporters outside the White House on Tuesday. “I don’t believe that. So we’ll see what happens.”
[emphasis mine]
In this exchange and past ones, Trump appeared to be referring to the “blue shift,” a phenomenon in which Democrats tend to gain votes as absentee and provisional ballots are counted after Election Day.
In the 2020 election, where mail-in ballots are being cast at historic levels and on an unusually partisan basis, it’s possible that Trump could get a lead on election night that slowly turns over the next few days into a Biden victory.
That disparity could lead Trump to follow through on his constant threats to challenge the election results in some fashion, perhaps by targeting mail-in ballots and then asking the Supreme Court to intervene on his behalf.
So transparent is Trump’s ploy to hold power that he and some Republican lawmakers all but stated they wanted Barrett on the court to help resolve any election-related cases.
The rest of Kavanaugh’s argument was riddled with errors and logical inconsistencies. At one point, he brushes aside Kagan’s note of how many people would be affected by the court’s move. “To take an analogy: How many people would file their taxes after April 15 if the filing deadline were changed to April 21?” he wrote, “Lots. That fact tells us nothing about how many people would file their taxes after April 15 if the deadline remained at April 15.” Faulty reasoning aside, the IRS thankfully only requires that tax returns be postmarked by April 15, not received by April 15.
Other factual errors abound: Kavanaugh claimed that Vermont had made no changes to its election law because of the pandemic—a point rebutted by Vermont Senator Patrick Leahy, who noted that the state legislature authorized the mailing of absentee ballots to every registered voter in the state.
Most troubling of all, Kavanaugh endorsed an extreme view of the Supreme Court’s power over election laws articulated by William Rehnquist, Antonin Scalia, and Justice Clarence Thomas in Bush v. Gore.
They argued that the high court has the authority to review state supreme courts, which generally have the final say on state legal disputes, when they interpret state election laws. As Slate’s Mark Joseph Stern noted last night, this theory not only clashes with major federalism precedents but sets up the Supreme Court to act as final arbiter on how states run their elections.
Though the other six justices in Bush v. Gore disagreed with Rehnquist’s theory, Kavanaugh nonetheless cited it as precedent on Monday night.
None of this comes as any great shock, unfortunately.
Kavanaugh spent most of his legal career as a Republican political operative: investigating the Clinton White House under Independent Counsel Ken Starr, working on George W. Bush’s legal team during the Florida recounts in 2000, and then serving in the White House Counsel’s Office and as staff secretary under Bush. From there, Bush nominated Kavanaugh to the D.C. Circuit Court of Appeals, the second most powerful court in the nation. Republicans knew what they were getting when they chose him to replace Anthony Kennedy in 2018, which is why they fought tooth and nail to get him on the high court.
[Amy Coney] Barrett, who also worked on Bush’s team in the 2000 election dispute, had multiple opportunities to demonstrate her independence and dispel concerns about partisan loyalty over the past month. During Gorsuch’s confirmation hearing in 2017, Trump’s first Supreme Court nominee openly criticized the president for his vitriolic attacks on federal judges who ruled against him and suggested he would be willing to do the same if the law required it. Barrett took a different path.
Her appearance on the White House balcony is more subtle than Kavanaugh’s concurring opinion, but it will provoke the same response...

BIG W in Sen’s Pre Season Game vs. Leafs
Its September 17th, and a big win for the Ottawa Senators as I'm writing this... well, maybe not a big win, but certainly a nice one for the boys to skate away with. Three to one with an empty net goal isn't exactly a comfortable win, and the Leafs certainly brought it, but with a united effort from the players and some better than solid goal tending the Sens are starting off the preseason on the right foot. Its not a big win of course, but it certainly is nice. Granted that neither team brought everything they had to bear for this game, as per usual for a preseason game, but we'll take what we can get.
Tumblr media
Things may seem to have started off slowly if you just look at the stat sheets, as both teams combined for only nine total shots on goal during the first period with the Sens being able to pot an admittedly weak goal. But there were plenty of good scoring chances, including a few that missed the net, and both teams had opportunities to get more. I would tend to agree with the three stars announcement on the radio that Anders Nilsson was the best player for the Senators.
The efforts of other players shouldn't be discounted though. Anthony Duclair was very visible in a positive way for the Senators, and got rewarded for his efforts with the empty net goal that really put the nail in the coffin. Tristan Scherwey had a great two point night, which included the game winning goal, making a pretty good case for himself on his professional tryout. Maxime Lajoie scored the first, and for two periods the only goal of the game.
It wasn't all positives though, not at all. The Senators only managed to log nineteen shots on goal during the game, which statistically is not going to be enough to win on most nights, and more than that, they went for several extended periods of time without getting any shots at all. That was probably because of the fact that the Sens spent quite a bit of time stuck in their own end chasing the Leafs players who kept solid possession. Really, in some ways the Sens managed to rope-a-dope their way to the win here. Special teams was also something of a split, as the penalty kill was perfect stopping the Leafs from getting anything on three powerplays, however the Sens own powerplay was equally inert, failing to score on three tries. Penalty kill was good, powerplay failed to produce.
I can't be too critical of course, because not all of the Sens best players were even in this game. No Brady Tkachuk, no Thomas Chabot, not even Colin White. So the Sens were missing out on some skill, some physicality and some fire power. All in all, I know logically that its a win against a rival in the preseason, so I should happily take it with a grain of salt. But the pessimist in me hopes that they have more to show than we got tonight. I'm always happy when the Sens win. I just wish they would do it in a more convincing fashion in the future.

FOCUS ON US (Kavanaugh, 2A1.1, Camps & Berrett & Ovalles)Catastrophe or Conundrum?
The NEW BLOG `                                                  FOCUS ON US `                              (Kavanaugh, 2A1.1, Camps & Berrett & Ovalles) `                                        Catastrophe or Conundrum?
Greetings!
So I have great news from OUR friend Shon Hopwood of 60 minutes fame. The Law professor from Georgetown and Chairperson for FAMM. I believe it was around 9/12/18 that he told me this but it seems Mitch McConnell has "seen the light". So to speak. He is now willing to call a vote on the First Step Act w/its "limited" SRCA (Sentencing Reform Act) amendments."3 The Hard Way" that is AG Sessions and his "gang" -of tough- on-crime aslong-as-its-toward-minorities cronies- Tom Cotton and Goodlatte and their "BAND OF ALT RIGHT BROTHERS"; want to stiffen and make MORE vague changes to the Guidelines. Luckily for us there is a "CHANGING' climate in this country that will certainly extinguish Some attempts at bringing this legislation to the floor. According to Shon things look much brighter. He believes -from working on Capital Hill- that the SRCA will be added to the FSA and will be passed SOON after November 1st. We will see. Quite a change- if you guy/gals remember- from when he told us WE HAD NO CHANCE. I guess you made the difference. I know I argued tooth and nail for you. Even asked you to take FAMM off your e-mails. so THANK YOU! -------
( Buried Alive Project)
Brittany is about her business. Our Friend Chris Poulos who worked for the former White House Drug Policy Division under Obama has told me that Brittany IS what she says she is. Hard working diligent w/a great heart and for JUSTICE. She had a Sept. 5th meeting at the White House w/ Trump's administration. The White House wants to work w/her about the clemency of Non-Violent drug offenders. The ones Obama's Clemency initiative left behind. Sally Yates White House counsel was behind alot of the denials according to THE TAWL FOUNDATION's investigation. She has also publicly stood behind her decisions to deny 1,000's of qualifying petitions. David Axelrod also agrees w/Sally Yates strategy.
The TAWL FOUNDATION estimates atleast 3,000 prisoners could be effected by the retroactive effects of the SRCA and the FIRST STEP and Trump and his White House could look at and consider as many for clemency. However, according to Brittany NO CLEAR path is set out for clemency the White House is keeping an open dialogue w/a woman who distains the effects of mass incarceration. So much for hating the Trump White House. -------
(Camp's v. Barrett v. Ovalles)
So we have a NEW set of cases using the CBA or "Conduct-Based-Approach" Instead of the CATEGORICAL APPROACH and the 2nd circuit in Barrett and the 11th Cir. In Ovalles some how state that a judge can look BEYOND the conduct found by the jury to facts NOT FOUND BY A JURY to determine if your conspiracy is a "violent offense". The problem w/all this is ONE CASE Leocal, 543 US 1 at 7 (2204). The CAMPS case out of the recent 6th Cir. Precedent also does not adopt the 2nd or the 11th Cir. ideology about THE CBA. It states "EXTORTION" FOR GUIDELINES PURPOSES & listed under the HOBBS ACT is not a violent offense. But all this hoopla about conspiracy offenses is coming from statements in DIMAYA like those made by Gorsuch. See DIMAYA 128 S.Ct. at 1233.
Furthermore, the Justices in Dimaya 138, S.Ct. at 1254-59 (Thomas Dissent) seem to want to create a conundrum. However, Mathis, 136 S.C.t at 2248 reiterates that a "predicate" conviction needs to found by elements not alternative means. Also See Dimaya, 138 S.C.t. at 1219; see, Jimenez Reciro, 537 US 270, 274 (2003). But again to get around all of that "they" throw s%^*& in the game by "implying" that REAL WORLD conduct may past Constitutional muster when in fact  LEOCAL says the NATURE OF THE OFFENSE is to be used . 5 Justices already support the "nature of the offense" approach which does not allow a judge to go past the elements needed to find the crime used to support the 924(c)(3)(B) conviction. They are KAGAN, The Notorious RBG, BREYER, SOTOMAYOR and GORSUCH. Moreover, even ROBERTS recognizes this is the proper scope. What's noteworthy is that 2 judges in Ovalles write a lengthy dissent. It is a 150+ page decision.
The 8th Circuit recently chimed in on this aswell. Agreeing with the 5 Justices. See Pickett, 830 F.3d 760, 761 (8th Cir. 2016). Conspiracy DOES NOT HAVE THE ELEMENT "the us or threatened use of force..." so how does it qualify as a violent crime? When it merely contemplates the underlying offense. Even the Court in Ovalles (11th cir.) knows " it seems that if we are required to apply the categorical approach in interpreting 924(c)(3)'s residual clause, as in McGuire and the Supreme Court did in Dimaya and Johnsons the [924(c)(3)] provision is done for".
Disomma, 951 F.2d 494 (2d Cir. 1991), is a case about BAIL REFORM conditions and what a "violent crime" is under the BAIL REFORM's residual clause. So yes another SUPER REACH. Just like in Johnson and Dimaya this "residual clause" language is nearly identical. THIS IS THE REASONING USED by the Conservative side of the 2d Cir. Court to state that Conspiracy "IS" its underlying act. So if the conspiracy is to commit a violent crime per, Disomma than the conspiracy itself MUST BE A VIOLENT CRIME. This reasoning assails not only logic but ALL THE PROTECTIONS of the constitution's 5th and 6th amendments. And maybe the 4th.
I told all of you years ago that BAD LAW only begets BAD LAW and it is ironic that the judges dissenting in OVALLES say the exact same thing. So where does this leave us? In a place "designed" for us to be? A Conundrum. The 4th Cir. seems primed to adopt the 5 justices interpretation of the use of the Categorical Approach. So what do we do? We Fight? Argue the correct law and wait. For what? For the Supreme Court to straighten out this SUPREME MESS. AGAIN. The longer we wait for someone elses case to be the difference the longer it will take. SO FILE NOW. You are the ONE who could be the difference. -------
(2A1.1)
BELL. The Bell case out of the D.C. Circuit. Is a case where Supreme Court Justice Kavanuagh explains how enhancements "WITH-IN" the statutory range are unduly substantive and unconstitutional. I want you to read it so I won't cite it here but it is a 2017 case. Kavanaugh laments that Uncharged and Acquitted (2A1.1) conduct used at sentencing is UNCONSTITUTIONAL. So if you were cheering for KAVANAUGH to get tossed off the Supreme Court the joke is on you. Infact it wasn't until ORIN HATCH a Republican Senator questioned him about uncharged and acquitted conduct did the "allegations' of an incident 36 year ago come up. How ironic?
The  "Murder-Cross Reference" is 2A1.1. Brett Kavanuagh the newly appointed Supreme Court Justice believes that -AND GET THIS- Uncharged and Acquitted Conduct is unconstitutional. Not just the 6th Amendment but the 5th Amendment aswell. Sound familiar? I said this 8 years ago right? In any case THE BELL CASE out of the D.C. Circuit explained this. MALCOLM X had a great speech he gave it was the BALLOT OR THE BULLET. He warned that poor whites and minorities should NOT subscribe to any particular party.
Don't let a political party turn you against someone- really anyone- who believes that the practices used against us are unconstitutional. Ask yourself this... with all you know and have been through, how many Judges and Politicians can pass a moral litmus test? So do you really think Blase-Ford was NOT sexually active at 14? And do you really believe Kavanaugh? No! RIGHT!  so lets focus on US.
So like I always say "Don't stay in prison longer than you have to!" Contact us here alot is going on we can help.
