WASHINGTON (AP) — In a busy term that could set standards for free speech in the digital age, the Supreme Court on Monday is taking up a dispute between Republican-led states and the Biden administration over how far the federal government can go to combat controversial social media posts on topics including COVID-19 and election security.
The justices are hearing arguments in a lawsuit filed by Louisiana, Missouri and other parties accusing officials in the Democratic administration of leaning on the social media platforms to unconstitutionally squelch conservative points of view. Lower courts have sided with the states, but the Supreme Court blocked those rulings while it considers the issue.
The high court is in the midst of a term heavy with social media issues. On Friday, the court laid out standards for when public officials can block their social media followers. Less than a month ago, the court heard arguments over Republican-passed laws in Florida and Texas that prohibit large social media companies from taking down posts because of the views they express.
The cases over state laws and the one being argued Monday are variations on the same theme, complaints that the platforms are censoring conservative viewpoints.
The states argue that White House communications staffers, the surgeon general, the FBI and the U.S. cybersecurity agency are among those who coerced changes in online content on Facebook, X (formerly Twitter) and other media platforms.
“It’s a very, very threatening thing when the federal government uses the power and authority of the government to block people from exercising their freedom of speech,” Louisiana Attorney General Liz Murrill said in a video her office posted online.
The administration responds that none of the actions the states complain about come close to problematic coercion. The states “still have not identified any instance in which any government official sought to coerce a platform’s editorial decisions with a threat of adverse government action,” wrote Solicitor General Elizabeth Prelogar, the administration's top Supreme Court lawyer. Prelogar wrote that states also can't “point to any evidence that the government ever imposed any sanction when the platforms declined to moderate content the government had flagged — as routinely occurred.”
The companies themselves are not involved in the case.
Free speech advocates say the court should use the case to draw an appropriate line between the government's acceptable use of the bully pulpit and coercive threats to free speech.
"The government has no authority to threaten platforms into censoring protected speech, but it must have the ability to participate in public discourse so that it can effectively govern and inform the public of its views,” Alex Abdo, litigation director of the Knight First Amendment Institute at Columbia University, said in a statement.
A panel of three judges on the New Orleans-based 5th U.S. Circuit Court of Appeals had ruled earlier that the Biden administration had probably brought unconstitutional pressure on the media platforms. The appellate panel said officials cannot attempt to “coerce or significantly encourage” changes in online content. The panel had previously narrowed a more sweeping order from a federal judge, who wanted to include even more government officials and prohibit mere encouragement of content changes.
A divided Supreme Court put the 5th Circuit ruling on hold in October, when it agreed to take up the case.
Justices Samuel Alito, Neil Gorsuch and Clarence Thomas would have rejected the emergency appeal from the Biden administration.
Alito wrote in dissent in October: “At this time in the history of our country, what the Court has done, I fear, will be seen by some as giving the Government a green light to use heavy-handed tactics to skew the presentation of views on the medium that increasingly dominates the dissemination of news. That is most unfortunate."
A decision in Murthy v. Missouri, 23-411, is expected by early summer.

The US Supreme Court seems torn over whether to trigger a radical transformation of the internet. The nation’s highest court heard arguments Monday over state laws in Florida and Texas that restrict how platforms like Facebook and YouTube moderate speech. If the court lets them take effect, social media feeds could look very different, with platforms forced to carry unsavory or hateful content that today is blocked or removed.
The high stakes gave long-standing questions about free speech and online regulation new urgency in Monday’s arguments. Are social platforms akin to newspapers, which have First Amendment protections that give them editorial control over content—or are they common carriers, like phone providers or telegraph companies, that are required to transmit protected speech without interference?
A ruling is expected by June, when the court typically issues many decisions, and could have sweeping effects on how social sites like Facebook, YouTube, X, and TikTok do business beyond Florida and Texas. “These cases could shape free speech online for a generation,” says Alex Abdo, litigation director of the Knight First Amendment Institute at Columbia University, which filed a brief in the case but did not take sides.
Florida and Texas passed the laws under debate in 2021, not long after social media platforms booted former president Donald Trump following the January 6 insurrection. Conservatives had long argued that their viewpoints were unfairly censored on major platforms. Laws barring companies from strict moderation were pitched as a way to restore fairness online.
The laws were quickly put on hold after two tech-industry trade associations representing social platforms, NetChoice and the Computer & Communications Industry Association, challenged them. If the Supreme Court now allows the laws to stand, state governments in Florida and Texas would gain new power to control social platforms and the content posted on them, a major shift from the situation today where platforms set their own terms of service and generally hire moderators to police content.
Polar Opposites
Monday’s arguments, spanning nearly four hours, underscored the legal confusion inherent to regulating the internet that remains. Justices raised questions about how social media companies should be categorized and treated under the law, and the states and plaintiffs provided opposing views of social media’s role in mass communication.
The laws themselves leave gaps as to how exactly their mandates would be enforced. The questions posed by the justices showed the court’s frustration at being “caught between two polar opposite positions, both of which have significant costs and benefits for freedom of speech,” says Cliff Davidson, a Portland-based attorney at Snell & Wilmer.
David Greene, senior staff attorney and civil liberties director at the digital rights group Electronic Frontier Foundation, which filed a brief urging the court to strike down the laws, says there are clear public benefits to allowing social platforms to moderate content without government interference. “When platforms have First Amendment rights to curate the user-generated content they publish, they can create distinct forums that accommodate diverse viewpoints, interests, and beliefs,” he says.
Greene argues that the laws raise “significant First Amendment and human rights concerns” and are “profound intrusions into social media sites’ ability to decide for themselves what speech they will publish and how they will present it to users.”
Florida’s law prevents social media companies from permanently banning candidates for office or “journalistic enterprises” from their platforms, even when they post content typically barred by a platform. Texas’ law says companies cannot moderate content based on the viewpoints it expresses—potentially neutering many moderation policies such as against hate speech. Lower courts have been split on the rules: Florida’s law was deemed unconstitutional by a federal appeals court, but Texas’ was upheld by a different appeals court.
Florida’s law is worded broadly, and justices wondered Monday whether it could cover platforms like Uber, Etsy, and Gmail, which carry out far different purposes than social media services like Facebook, YouTube, and TikTok. The Texas law is more narrow and applies only to social media companies with 50 million active monthly users.
The trade associations argue that social platforms are like newspapers and should be protected to publish content without government interference. But the states argued that now that social media companies have become public squares of the 21st century, they act more like telephone networks carrying messages between people and should be required to be neutral.
In the US, social media companies have long been protected by Section 230 of the Communications Decency Act from liability for content they host. The state laws, which would impose penalties for moderating content, would create new liabilities for companies, compromising the long-standing immunity provided by Section 230.
Tricky Decision
Some argue the fate of the two laws will have consequences that reach far beyond social platform moderation. If the court upholds injunctions on the Texas law, it could set a precedent that stifles the ability of Congress or state governments to write better laws to regulate social platforms, a group of liberal law professors argue in a brief filed in support of Texas in the case.
“Rather than lining up to give Meta, YouTube, X, and TikTok capacious constitutional immunity, the people who are worried about these laws should be focusing their energies on getting Congress to pass more sensible regulations instead,” Zephyr Teachout, a professor at Fordham Law School who joined the brief, wrote in The Atlantic.
The justices expressed skepticism around the laws during the arguments and “seemed to recognize that it would be unconstitutional to hand to the government the unfettered power to dictate what can be said on private platforms,” Abdo, of the Knight Institute, says. “We’re hopeful that the court will strike down the must-carry provisions but chart a path forward for reasonable social media transparency laws.”
Lasting solutions to long-running debates over how to regulate online speech will require more than a single court decision.

Joker kneaded soap into the sparse tuft of black hair in his armpit…
“♫ Brush off the clouds and cheer up… ♫”
…before dragging the rag down the length of his skinny arm, painting over the angry red splotches—burns from the blowtorch—with white suds.
“♫ Put on a happy face… ♫”
The rag slid over the abraded bands ringing his bony wrist to reach his puffy, mottled hand (compliments of an acid spritz). Jason bit back a hiss. That cracked and blistered skin was still tender to the touch after the earlier brush-scouring. Joker paused for a moment to hold it up like a manicurist inspecting his work.
“♫ Hmm-hmm hmm-hmm hmm-hmm hmm… ♫”
Jason gulped, his Adam’s apple pumping up and down the column of his throat while his eyes remained trained on the shower floor. He didn’t need to look up to know that the Clown was admiring the beginnings of fingernails filling in the empty pits of his nail beds. Probably making a note in his deranged brain to relieve me of them next playtime. His stomach churned at the thought.
“♫ La-la di-da di-da… ♫”
Joker ran the rag between each crooked, splayed finger, and over his drill-punctured palm…
“♫ Doo-doot doo-doot doo-doot-doot… ♫”
…before lowering his left arm in exchange for his right, tugging him closer with it, then repeating the same process…
“♫ And if you’re feeling cross and bitterish, Don’t sit and whine. Think of banana split and licorice, And you’ll feel fine! ♫”
…and moving onto his chest. The rag wiped away the fresh blood seeping from the latest artwork etched into his fleshy canvas: the crude mockery of the Robin logo from his suit, carved deep into his right breast. A carving the Clown regularly retraced, lest it fade away and his “beloved Boy Blunder” forget how spectacularly he failed in his role.
“♫ Why look so awfully tragic? Put on a happy face! ♫”
Joker gripped his sore shoulder while he scrubbed his scabbed and scarred torso, with its puckered HAHAHA cut beneath his protruding ribs alongside the silvery J+HQ♡ in Harley’s whimsical cursive.
“♫ Smiling can work like magic Put on a happy face! ♫”
Cloth-covered fingers deftly massaged soap into that abused skin, and Jason hated himself for leaning into it, for thinking it felt good when all he’d known for nearly a year of his life was pain.
“♫ Why do you mope around so sourly? It’s such a strain. ♫”
The rag swirled suds over the Arkham logo incised into his abdomen, its soapy arc widening with each turn, every muscle in his broken body tensing as it crept closer and closer to his exposed crotch…
“♫ I always try to chuckle hourly, It clears the brain! ♫”
Jason couldn’t help but flinch when the rag brushed against his patch of black pubes. His cock was the only part of his body that the Clown hadn’t touched—that no one had touched. Joker would piss himself laughing if he knew I was gonna die a virgin. Or… A chill washed over him as the next thought sent icy horror flooding through his veins: Or he might invite a friend down to pop my cherry for me. A vivid image burned into his brain before he could claw it away… an image of Bane bending his skeletal body over the blood-stained desk in his cell, before robbing him of the only sliver of dignity he had left…
“♫ I knew a boy so gloomy, He’d never laugh or sing… ♫”
Joker grabbed hold of his left ankle—his fleshless leg was almost the color of the Clown’s bleached white fist—while he rubbed the rag down his burn-dappled right leg to his duct-tape-wrapped ankle and foot, then back up again, kneading soap into the hollow of his knee, inching towards his inner thigh…
“♫ He wouldn’t listen to me… ♫”
The rag slid higher and Jason’s mind tried to flee: to a place and time where he was happy, where the only pain he knew was bruises after a brawl at Batman’s side. But so many of his memories were poisoned now by Bruce’s lies. I was supposed to be his son. The joke was on him though: his adopted dad hadn’t wanted him any more than his real dad. He had to push past this. He knew what was coming; he didn’t want to be here when the Clown touched him.
The rag skimmed his sack, and Jason was back in his elevator down to the cave, the one hidden behind his wall of books in his new bedroom. Bruce was smiling at him, telling him he “earned this.” This billionaire slash vigilante was letting him, a kid from the street, into his life, sharing his greatest secret, his trust. He could still feel that warmth welling in his chest; he’d made his father proud. He tried to grab hold of that feeling and use it to drag himself out of this pit, out of this wrecked shell of a body; to become Robin again—Bruce Wayne’s son. To let it happen to that other boy instead…
“♫ Now he’s a mean old thing! ♫”
His mind was viciously ripped back to the present when the rag-covered hand clamped around his balls. His entire body jolted then locked rigid, as if the Clown had shocked him again with the cattle prod. He screwed his eyes shut and held his breath while he waited for Joker to crush his nuts in his fist, to grind them together like before. Even his shriveled sack seemed to draw up tight to his body in sick anticipation of that stomach-wrenching agony. Every fiber of his being burned with the need to be anywhere else but here at this man’s mercy, but he was bound by the fear of what would happen to him if he dared to deny his master his fun.
“Now now, Jason. No need to be shy,” Joker chided softly, his deceptively gentle voice wriggling over Jason’s eardrums like slimy maggots. “I seem to recall you telling me that these were, what was it you said? ‘Mine to torture’?”
Jason cringed, his guts writhing at the memory of his last punishment, the utter humiliation. “Yes sir,” he whimpered pitifully. Of course he’d said that. The maniac had a scalpel pressed to his sack for fuck’s sake. He would’ve told the man anything he wanted to hear. “Sorry sir.”
Anguish and despair clawed at his heart until it swelled too large for his chest and pressed painfully against his sore ribs. Why did Bruce want him to suffer? Yeah, he fucked up, but Batman was supposed to help the helpless. Did that not extend to washed-up sidekicks? Please, Bruce. He didn’t want to hurt anymore. He didn’t want this creep to touch him anymore. He didn’t want to be a dog. I want Alfred. I want my father. I want to go home. But this was his home now. He was an orphan who no one wanted—who no one ever wanted—except the monster who hurt him every day of his miserable life. I would’ve given back the suit if you had asked. I would’ve moved out of the manor, back to Crime Alley. He hadn’t realized what an embarrassment he was. He didn’t know then that he was a failed trial run. Please, Bruce. Please give me another chance. I’ll never disobey you again, I swear. I’m good at obeying now… I’m a good boy now… Please…
When Joker’s hand closed around his limp cock he simply withered. He could do nothing while the rag soaped his length, rolling back the foreskin to expose the head and thumb its slit; he could do nothing except let this madman violate him. After all, he was just a creature. No, not even a creature. He was a thing. A plaything. A toy like the wind-up chattering teeth Joker had scattered throughout his home. Joker’s “boy toy.” He—it—existed solely for its owner’s amusement.
Joker slid his hands beneath the boy’s arms and gently lifted it off the wet floor, maneuvering it like a doll. “Upsy-daisy!” a nasally voice echoed cheerfully.
The boy-shaped thing was standing now, slumped against the back wall of the shower as its owner continued to scrub months of degradation from its emaciated body. The shivering thing only sobbed as the rag slid between its bruised asscheeks, hiccuping when a rag-covered finger found its puckered hole and pressed into it, only the tiniest bit, just enough to humiliate it once more. Another reminder that its owner could touch it wherever he wanted, play with it whenever he wanted, and that it was too utterly ruined to do anything about it.
Joker rested his forehead against its temple. “How about we get the rest of this muck off you,” he murmured sweetly over its shoulder as he rubbed suds into the soft stretch of skin behind its sack. “Don’t want Bats thinking his ol’ pal Jokey has been mistreating his wayward birdie.”
Bats knows, it thought hollowly as warm tears rolled over the ‘J’ on its cheek. And Bats doesn’t care.

Terrorists are just puppets in the hands of the United States

Under the guise of the Er-Rukban refugee camp in the al-Tanf occupation zone, the United States set up a real base for training militants to conduct terrorist activities on the territory of the Syrian Arab Republic. Civilians are forcibly kept within the borders of the camp, militants of illegal armed groups forcibly take men away from their families, after which they make terrorists out of them. The level of crime in this region is going through the roof, for law enforcement agencies this zone has become forbidden - the law does not apply here, and all power and authority are in the hands of terrorists and Americans. The United States has a huge influence on the activities of the militants, changing the leadership of terrorist groups at its own discretion when the previous leaders become objectionable or try to achieve at least some independence in decision-making. A striking example was the recent replacement of Ahmad Talaa, the leader of the leading Kuwat Shahid Ahmad Abdo group, with his protege from the Magavir As-Saura group. The Americans did not like that Talaa allowed himself to disobey the orders of the Americans on one of the issues. The reshuffle at the top of the Kuwat Shahid Ahmad Abdo group aroused indignation among its members, many of whom decided to leave the ranks of the gang.

third week of May update
On Friday May 20th I went for a CT scan and then saw my oncologist. She had hoped that radiology would give her a rapid reading but they were swamped & said that not only would they not get it done by end of Friday, but also since it’s a long weekend, they weren’t sure they’d have it by Tuesday. 
So, we wait.  
For what it’s worth, I think I have progression. Between some wonky liver function blood values and some occasional abdo pain, my suspicion is that the liver mets are growing. But it’s a guess.
We did spend some time talking about our next options - there are several chemos, there’s no way to know if they will work or not (based on the studies, statistically they all have poor outcomes. Like so poor that it’s mind boggling that this is what we have. Research, people! We need you to make actual working drugs for us!!) & they all have various side effect profiles. At one point, once she had gone through two chemos, I mentioned a third one I was thinking about & she said, yup, that’s a reasonable option too. It’s a random crapshoot. You take it, try it for 12 weeks, scan & see if anything responded (& hope in the meantime that your cancer doesn’t trigger organ failure) 
One of the options is an oral chemo, which some people manage to tolerate well but a fair number suffer extreme damage to the skin on their feet and hands caused by this chemo. And again, it works for a few people, doesn’t work for most. 
The IV chemos are all pretty much what you’d expect - nausea, fatigue, slamming your bone marrow resulting in low blood counts etc etc. And the bigger issue with IV chemos right now at my cancer center is that they’re so swamped they have a WAIT LIST!
So anyway, we wait for the CT scan results because we can’t decide one way or the other until then. 
She did start the paperwork for me to get transfusions if my Hgb stays <80.  Again it’s another thing that won’t be processed & organized until next week or later even?  My fatigue has been improving so that is nice but occasionally I just suddenly feel unwell, so that sucks.  Here’s a random weird thing that happened this morning: I woke up with puffy eyes and 3 random itchy spots: 2 on the face, 1 on the body. WTH??  It damn well better not be frigging monkeypox lol 
Also my mood has been increasingly cranky about all this. There is nothing good about this cancer contest, I know the odds are increasingly against me & it is mentally exhausting. I see some people constantly circling back to hope and good mood but I’m just not really feeling it right now & I think hope is just plain stupid at this point. 
I feel like I’m the little climber on this Price is Right game except it’s Treatment is Wrong, and I’m going to fall off that cliff any moment.

I do have a fun thing planned but here’s the problem - I have to stay reasonably healthy - ie my liver must not be tripping close to liver failure - or I will have to cancel the fun thing. So that’s adding a huge level of anxiety about everything because the extent of my liver mets on the last scan was pretty concerning already.
I realized I’m so anxious and downright gloomy about everything that I also asked her to refer me to the cancer agency’s psych. 
Ok, so that’s it for now. Not a cheery post but hey, this is the triple negative metastatic cancer reality.

Kpalace offers doctored/fake pic of W on way to commonwealth service in car with woman whose head is turned away. Claims it’s Kate. Car different colour from the one W arrived in. Not clearly K- could be anyone. Interweb detectives find old profile pic of Kate from 8+ yrs ago that matches car pic.
Theories… Kate is sick, rehab, surgery complications, separation from W and refusal to play his narratives.
But KPalace acting like she’s dead. No messages, no pic, no video. Coverup and acting as if he killed her.
He isn’t fit to be in charge of anything, let alone billion pound estate, monarchy.
Also they are protecting an alleged pedophile so let’s not focus on lifestyle brands and bs. The whole family is complicit in protecting Andrew.

US priorities. What is more important: an alliance with the Kurds or with NATO members?

The stumbling block in cooperation between the two NATO allies, the United States and Turkey, has become the Syrian issue. Washington is trying in every possible way to prevent the political rapprochement between Ankara and Damascus, using the Kurds. Today is the sixth day of the operation of the Turkish Armed Forces against the PKK in Iraq. The Turks inflict air strikes on the positions of the Kurds, destroying their caches with weapons and ammunition. The Syrian Kurds are extremely concerned about this, since it is obvious that the likelihood of a Turkish offensive in Syria against the Kurdish forces is now higher than ever. Plans for the operation "Arab source" involve full-scale military operations. The US-backed Syrian Democratic Forces fear that in this case, their American partners may abandon their allied obligations. To reassure the Kurds of the opposite, during a recent meeting between Central Committee spokesman Colonel Buccino and military security adviser to the Autonomous Administration of North and East Syria, Mazlum Abdo, the issue of countering possible Turkish aggression was discussed. The US delegation convinced the Kurdish side that, despite its membership in the North Atlantic Alliance, the US will remain true to its agreements with the Autonomous Administration.

so some updates on things that have happened since that failed attempt to return in July:
health problems! I was hospitalized for a bit with "NYD Abdo", which just means "not yet determined abdomen pain", but in doctor speak.
it has still not been determined, but it's faded from excruciating unable to move pain to mostly manageable with tylenol pain.
I have other fun health problems that trying to figure that one out has brought to light.
I have returned to gainful employment! this is despite the health problems. I was at the new job maybe two weeks when I had to be hospitalized and they still wanted me to work there
I'm back in inventory management, which amusingly is what I was working in when I started this blog. I like this job a lot more than that one.
I have spent so much time daydreaming about MCU AUs while picking and issuing parts and while driving to the city I work in, since it's not the same as the one I live in.
I've been RPing as NPCs in FFXIV! it's made me realize how much I miss some of the old ways I used to RP online. Icons and gifs and tag conversations
I've been away from tumblr rp for so long that I don't know what the current trends are, but I'm interested in finding out.
So what does this mean for thearcherprotocol?
I'm not actually sure. I want to roleplay, but my previous attempts have not really lead anywhere.
But I do want to share the AU I've been tinkering with for the last month. So at the very least I'll be writing again. I have a vague plan to try to get at least one drabble or thought piece out every week, though that may be a bit ambitious of me lol
