Bankruptcy filings rising across the country (NY Post) Bankruptcies are back--flashing warnings that more Americans are knee-deep in debt in big cities like New York. While total bankruptcy petitions nationwide by consumers and businesses are still well below Great Recession levels, analysts say there is an unmistakable trend upward. New York state’s bankruptcy filings, for instance, have risen steadily the past three years, hitting 34,711 in 2018, up from 30,112 in 2016, according to the American Bankruptcy Institute (ABI). Baraka’s comments came after the latest twist in Newark’s long-running water problems. Tests in recent days showed that the water filters the city provided to residents might not be adequately blocking lead, according to federal and local officials.
New Trump rules would further restrict legal immigration (AP) The Trump administration is moving forward with one of its most aggressive steps yet to restrict legal immigration, denying green cards to many migrants who use Medicaid, food stamps, housing vouchers or other forms of public assistance, officials said announced Monday. Federal law already requires those seeking to become permanent residents and gain legal status to prove they will not be a burden to the U.S.--a “public charge,” in government speak --but the new rules detail a broader range of programs that could disqualify them. While much of the attention has focused on President Donald Trump’s efforts to crack down on illegal immigration, the new change targets people who entered the United States legally and are seeking permanent status. Its part of an effort to move the U.S. to a system that focuses on immigrants’ skills instead of emphasizing the reunification of families.

One out of five Russians wants to leave the country (Washington Post) A recent Gallup poll made headlines in Russia with the revelation that a record 20 percent of the population wanted to leave their country. Protecting your constitutional rights during a workplace raid
In the United States, every person — whether documented or undocumented — has the constitutional right to remain silent and refuse to answer questions of the police, FBI, or ICE, whether on the street, in a car, or at home.
Under the law, ICE must have proof you are not from the United States to deport you. They can use the following information against you:
If you run and ICE catches you
If you tell ICE where you were born or that you don’t have papers
If you carry false documents
If you carry papers from your country
If you are questioned by ICE, you are NOT required to reveal any information, such as your name, address, or home country. If you are questioned or detained, however, it usually is a good idea to give your name so that friends, family, or your attorney can locate you.
What you can do now
The targets of the mass raids are individuals who have been ordered deported.  Any individuals that were issued deportation orders because of failure to appear in court, should contact a reputable immigration lawyer, nonprofit, or immigrant rights organization to help them file a motion to reopen their order of deportation.
Gather and keep important documents in a safe place, make copies, and make them accessible to a trusted person.
Identify reputable immigration, family, and defense lawyers for rapid response. Speak to a family law attorney about the need to sign a power of attorney for the caretaking of children and handling finances.
Obtain travel documentation for all family relatives.
Carry a Know Your Rights card with contact information of reliable attorney and other emergency contacts. Memorize important phone numbers.
If you are stopped by ICE or if ICE comes to your home
DO NOT OPEN THE DOOR if an immigration agent is knocking on the door.
DO NOT ANSWER ANY QUESTIONS from an immigration agent if they try to talk to you. You have the right to remain silent.
DO NOT SIGN ANYTHING without first speaking to a lawyer. You have the right to speak with a lawyer.
If you are outside of your home, ask the agent if you are free to leave and if they say yes, leave calmly.
GIVE THIS CARD TO THE AGENT. If you are inside of your home, show the card through the window or slide it under the door. The cards read:
“I do not wish to speak with you, answer your questions, or sign or hand you any documents based on my 5th Amendment rights under the United States Constitution. I do not give you permission to enter my home based on my 4th Amendment rights under the United States Constitution unless you have a warrant to enter, signed by a judge or magistrate with my name on it that you slide under the door. I do not give you permission to search any of my belongings based on my 4th Amendment rights. I choose to exercise my constitutional rights.”
These cards are available to citizens and noncitizens alike.
During a workplace raid

ICE must have a judicial warrant (a warrant SIGNED BY A JUDGE) or the employer’s permission to enter the workplace.
ICE can enter a public place without a warrant.
Workers should stay calm.
Workers should not run. Union representatives should not warn workers that immigration has arrived or urge them to run.
A union observer should document (write, not film) events taking place during a raid.
Workers have the right to remain silent.
Workers have the right to an attorney.
Workers have the right to refuse to sign anything without talking to an attorney.
ICE is not supposed to take someone’s fingerprints unless ICE already has a reason to arrest them. Workers should NOT consent to being fingerprinted, and if they are, they should say out loud that they do not agree with being fingerprinted.
If ICE arrests you, you have the right:
To remain silent and refuse to answer questions. Anything you say may be used against you.
To understand the charges against you. If you need an interpreter, ICE must provide one.
To be represented by an attorney (at your own expense) and to receive a list of agencies offering free legal services before answering questions.
To refuse to sign documents, such as for voluntary departure. It is particularly important to consult with an attorney before signing if:
You are afraid to return to your home country
You have lived in the U.S. for at least 10 years
Your family members have amnesty or other papers
You already have a pending ICE case
You are accused of using false documents
To make a telephone call to an attorney, family member, consulate of your home nation, friend, or the union (memorize their phone numbers).
To be released on bond and to have a hearing to reduce your bond if you cannot afford it.
To have a hearing before an immigration judge and to appeal any adverse decision by the judge. You have the right to stay in the U.S. while you appeal.
How can the UFCW help workers during workplace raids?
The union should enforce employer obligations on issues that affect immigrant members. The union could be liable for failing to represent members if it fails to challenge employer abuse. The union has no reason to determine the immigration status of a worker; unions must represent all workers regardless of status. However, a union representative must not assist a worker in presenting documents that the representative knows are false.
The union may request information about and bargain over employer I-9 audits.
Request information about the reason for and the scope of the audit, and request copies of any documents the employer received from any government agency.
The union may represent workers in reverification of work authorization documents.
Employers are only allowed to reverify identity and work authorization documents for expired documents, such as an expired work permit or visa, but not for a lawful permanent resident card with an expiration date. If the reverification is based on the expiration of the employee’s work permit, bargain for an unpaid leave of absence. Object to unlawful reverification of current workers such as non-citizen nationals, lawful permanent residents, refugees, asylees, or individuals with temporary protected status. Weingarten allows a union representative or steward to be present if an employer seeks to meet with a worker regarding employment authorization or other immigration issues. Grieve any adverse actions against workers based on unlawful reverification attempts.
If an employer gets a SSN “no-match” letter, the union can remind them that:
A “no-match” letter does not provide authority for an employer to terminate, suspend, lay off, or impose other discipline on an employee, and an employer who does may violate federal labor law.
The purpose of a “no-match” letter is to notify an employer when a reported employee’s name or social security number does not match Social Security’s records. The SSA has no authority to enforce the immigration laws, and the employer should give employees an opportunity to update their documents and information.
Ensure that contracts have provisions that state: “The Company will not discipline, discharge or otherwise act against any worker who is absent from work for up to [NUMBER] days because of arrest, detention or incarceration, and those days will not count against the worker’s time and attendance record.”
Engage with employers about immigration enforcement to establish protocols for their interaction with ICE in the workplace. (E.g. confirm that ICE may not enter private property without a warrant signed by a judge.)
Train members, stewards, and staff on the basic rights of individuals during an immigration enforcement action, the union’s rapid response plan, and family safety plans.
Establish relationships with local community leaders, allies, non-profits, immigrant rights groups, and legal service providers to be in communication during raids and mobilize the community to support workers and families.

Jeff Sessions Was the Worst Attorney General in Modern American History
From immigration to transgender rights, Attorney General Jeff Sessions showed contempt for American civil rights and liberties.
On Wednesday, the Trump administration bid farewell to one of its most infamous members: Attorney General Jeff Sessions. In his brief tenure, Sessions managed to dismantle and rescind an astounding range of efforts by prior administrations to protect civil rights and civil liberties and introduced new policies that endanger some of the most vulnerable citizens in the U.S.
From his draconian approach to immigration policy to his efforts to erase protections for transgender people to his many moves to dismantle his predecessors’ attempts to decrease the federal prison population, the list of Sessions’ offenses is long. We’ve rounded up some of the former attorney general’s most egregious actions below to showcase Sessions' contempt for civil rights and liberties.
Immigration
Sessions did everything in his power to speed up deportations and aid the separation of families, issuing a series of policies that trampled on due process. The Justice Department ended a program to notify immigrants of their rights during deportation cases, set arbitrary and unreasonable quotas for immigration judges, and repeatedly overruled immigration court and Board of Immigration Appeals' decisions on his own initiative.
This summer, the former attorney general attracted criticism from U.S. District Judge Emmet Sullivan for requiring victims of domestic violence seeking asylum to meet a nearly impossible threshold during the asylum screening process. Following the summary deportation of two ACLU clients, a woman and her child who fled rape and other brutality in El Salvador, Judge Sullivan asked: “Somebody in pursuit of justice who has alleged a credible fear in her mind and is seeking justice in a United States court is just spirited away?” He went on to order the government to “turn the plane around” and return our clients to the U.S.
In September, the ACLU published a first-person account of a survivor of domestic violence from Mexico who was granted asylum prior to the introduction of Sessions’ new policy. “People like me come from countries where the police and justice system do not protect women and girls,” she wrote. “For the United States to deny us refuge says our lives mean nothing.”
Under Sessions, the Justice Department also made a series of increasingly desperate attempts to bully states and localities into colluding with its draconian detention and deportation agenda, in spite of being repeatedly blocked by the courts. And Sessions fully endorsed Trump’s decision to end the DACA program, which provides protection from deportation to hundreds of thousands of undocumented young people who came here through no fault of their own.  Sessions maintained that the relief, granted by the Obama administration, was an “unconstitutional exercise of authority by the Executive Branch.”
Criminal Justice
Sessions’ efforts to dismantle civil rights and civil liberties protections gained during prior administrations are especially apparent when it comes to criminal justice. He rescinded multiple Obama-era memos, including one that directed federal resources away from enforcing federal drug laws in states that have legalized medical or recreational use of marijuana. The move was part of the former attorney general’s fear-driven agenda to reinvigorate the War on Drugs and to systematically dismantle his predecessors’ efforts to reduce federal imprisonment rates. Among those efforts was Sessions’ directive to prosecutors to bring the harshest possible cases against defendants — including people like Marion Hungerford, a mentally ill woman who was sentenced to 159 years in federal prison for helping to commit a string of armed robberies, even though she never touched the gun.
In May, Sessions falsely claimed that the settlement between the ACLU of Illinois and the Chicago Police Department was to blame for hundreds of deaths and shootings in the city. The landmark agreement followed the release of a groundbreaking report documenting officers’ unlawful use of stop and frisk. Sessions’ assertion that abiding by the Constitution increases crime is unsupported by the evidence and deeply flawed as a matter of principle. 
Throughout his tenure, Sessions resisted efforts to make the work of prosecutors more transparent and fair. Just last month, the Justice Department opposed the release of an opinion by the Tennessee Board of Professional Responsibility that required federal prosecutors working in the state to disclose all information favorable to criminal defendants.
Sessions also sought to limit the work of the Justice Department’s Civil Rights Division. Efforts to seek justice for people killed during police encounters have been dismissed, such as when the Justice Department declined to pursue federal civil rights charges against the officers involved in Alton Sterling’s death, or have been stonewalled, as in the prolonged civil rights investigation into the killing of Eric Garner.
Under prior attorney generals, the Justice Department undertook numerous civil rights investigations into local police departments and entered into consent decrees seeking to end racially discriminatory police practices in places such as Seattle; Los Angeles County; New Orleans; Baltimore; Newark; East Haven, Connecticut; and Ferguson, Missouri. But with Sessions’ arrival, an era of systemic police reform in cooperation with the federal government came to an end. In a March 2017 memo, Sessions instructed Justice Department officials to stay out of local police officers’ business. He has also ended a critical community policing program formerly used to address racial profiling and other issues, such as excessive use of force. And just before Sessions tendered his resignation on Wednesday, he signed a memo making it harder for the Justice Department to enter into consent decrees with police departments accused of civil rights and liberties abuses. 
Transgender Rights
Shortly after Trump was inaugurated, Sessions began systematically reversing hard-won legal protections for transgender people. In February 2017, the Justice Department revoked a guidance issued in 2016 by the U.S. Departments of Education and Justice on the rights of transgender students under Title IX.
In May 2018, the former attorney general took his efforts to dismantle protections for transgender people into the criminal justice system when he introduced a new policy mandating prison placements based on assigned sex at birth, except in rare cases. The policy, which endangers transgender people in prison, replaced a former rule, which required that gender identity — a person’s authentic, core understanding of their own gender — play a central role in whether a person is held in a male or female prison.
In October of this year, the Justice Department filed a brief with the Supreme Court attacking an appeals court decision in favor of our client Aimee Stephens. Aimee, a transgender woman, was fired from her job of six years at a funeral home after coming out to her employer. After Aimee sued the funeral home, the Court of Appeals for the Sixth Circuit ruled for her in March, stating that discrimination against transgender people is a form of sex discrimination that violates Title VII of the Civil Rights Act of 1964. “No one should be fired because of who they are,” Aimee wrote for us in October.
Sessions disagrees. The Justice Department’s critique of the appeals court reflects its ongoing attack on transgender people. And last year, Sessions declared that transgender people would no longer be protected from sex discrimination under Title VII, changing the rules for all federal programs. Attacks like these bolstered an October announcement that the Trump administration plans to eliminate nondiscrimination protections for trans people found in federal civil rights law by changing the definition of “sex.”
Voting Rights
Voting rights also came under attack during Sessions’ reign over the Justice Department. A controversial memo from the Department of Commerce to the Census Bureau in 2018 mandating the addition of a question on citizenship to the Census was triggered by an earlier request from a Trump appointee in the Justice Department.
When career civil rights attorneys in the Justice Department refused to sign on to efforts by the administration to roll back voting rights, Sessions — who once called the Voting Rights Act “intrusive” — simply cherry-picked political appointees to work on those issues instead.
After Sessions
Following Sessions’ forced resignation, Trump quickly moved to place Matthew Whitaker as acting attorney general. Whitaker, a lawyer and former prosecutor, was Sessions’ chief of staff. There is little reason to believe that he will not follow in his predecessor’s footsteps on issues of civil rights and civil liberties. All those who care about civil liberties and civil rights will need to keep a close eye on the Justice Department. Sessions’ tenure was a disaster, and his replacement promises more of the same.

Judicial Watch Sues for Documents on Mueller’s Abusive Raid on Trump’s Lawyers
In April, Special Counsel Mueller and the DOJ crossed yet another bridge too far, when Mueller recommended, and Deputy Attorney General Rod Rosenstein approved, a raid on President Trump’s then-personal attorney’s home and office.
At the time of the raid, I tweeted: “The raid is just one more reason to shut the Mueller operation down – it’s constitutionally suspect, ethically compromised, & frankly has no reason for being – given the fact that there’s no evidence of @RealDonaldTrump-Russia collusion.”
Judicial Watch began an investigation that has resulted in another JW “Mueller oversight project” lawsuit.
We filed a Freedom of Information Act (FOIA) lawsuit against the Justice Department for all records related to the April 9 raid on the office, home and hotel room of Michael Cohen, then-personal attorney to President Donald Trump ( Judicial Watch v. U.S. Department of Justice (No. 1:18-cv-01466)). The suit was filed in the U.S. District Court for the District of Columbia after the Justice Department lawlessly failed to respond to three separate FOIA requests.

On April 9, 2018, the FBI raided the home, office and hotel room of President Trump’s personal attorney, Michael Cohen. Prosecutors obtained the search warrant after receiving a referral from Special Counsel Mueller’s office conveyed through Deputy Attorney General Rod Rosenstein. Lawyers for Michael Cohen reportedly completed a review of the over four million seized files from the raids and “found that 12,061 are privileged and shouldn’t be viewed by government lawyers.”
On its face, the raid on then-President Trump’s lawyer seemed abusive and out of line. And so it is not surprising that the Mueller Special Counsel and the Justice Department would ignore FOIA law and refuse to respond to our basic requests for information about this extraordinary raid. We’ll keep you updated.
The Majority of Immigrants ICE Arrests are Convicted Criminals
The contrived hysteria over the treatment of children has metastasized among the open borders Left into demands, peppered with lawlessness and violence , to eliminate the Immigration and Customs Enforcement (ICE) agency. Here’s an inconvenient truth: ICE protects us from criminals, as our Corruption Chroniclesblog points out .
As a growing number of Democrats and their allies call for abolishing Immigration and Customs Enforcement (ICE), it’s important to remember that the overwhelming majority of illegal immigrants arrested by the agency have criminal convictions. In 2017 immigrants with criminal convictions accounted for 74% of all arrests made by ICE, according to government data used by the nonpartisan Pew Research Center in a study published earlier this year. Sixteen percent of those arrested by ICE had pending criminal charges and only 11 % had no known criminal convictions or charges, the Pew analysis found.
Nearly 60,000 illegal aliens deported by ICE last year were convicted of driving under the influence of alcohol and another 57,438 for possessing or selling dangerous drugs such as opioids. 
More than 52,000 ICE arrestees were convicted of immigration offenses, including false claim to American citizenship and tens of thousands had pending criminal charges for assault, driving under the influence and a variety of other crimes. Some had pending charges for more violent crimes like sexual assault, kidnapping and homicide. 
Los Angeles, an illegal alien sanctuary city, topped the list with nearly nine out of 10 ICE arrests consisting of immigrants with criminal convictions. Newark, New Jersey had the lowest number with 60% criminal arrests but every region had one thing in common: “In all ICE areas, considerable majorities of arrests were for those with prior convictions,” the Pew study says.
The figures make the calls to abolish ICE, the 20,000-employee Homeland Security agency, preposterous. The growing movement includes elected officials—some presidential contenders—at the federal, state and local level as well as those running for office. Among them are senators Elizabeth Warren (Massachusetts), Kamala Harris (California) and Kirsten Gillibrand (New York). Warren and Harris are reportedly making White House runs in 2020. 
Other federal lawmakers calling for the dismantling of ICE include Wisconsin Congressman Mark Pocan and Massachusetts Congressman Mike Capuano. In a piece published by a mainstream media outlet, a law professor running for New York Attorney General writes that ICE is a “tool of cruelty and lawlessness and dehumanization.” The agency was born in xenophobia and fear, the lawyer asserts, and it is doing exactly what it was designed to do: “Terrorize immigrant communities, bring a police state inside our borders and treat people as less than human.”
Not surprisingly, the mainstream media appears to support the abolish ICE movement and has demonstrated it with biased reporting as well as the promotion of radical leftist ideas such as those published by the New York Attorney General candidate. A mainstream national newspaper writes that the nation doesn’t need ICE and refers to it as an “agency that harms Latino and immigrant communities.” 
A northern California newspaper blames the Trump administration’s “hardline immigration policies” for transforming the idea of abolishing ICE from a pipe dream for liberal activists to a legitimate political issue. The article refers to abolish ICE as a movement that has seen a “remarkable rise from fringe issue to Democratic rallying cry.” A multitude of media outlets around the country have followed suit, shamelessly displaying their pom poms for the insane abolish ICE movement.
The reality is that ICE needs to be strengthened because the agency is overwhelmed, officers can’t keep up with monstrous workloads and repeatedly lose track of hardcore criminals inside the United States. As a result hundreds of thousands of illegal aliens with criminal records are getting released by local authorities in the U.S., according to a federal audit released last year by the Department of Homeland Security (DHS) Inspector General. 
A surge in illegal immigrants under the Obama administration pushed matters into crisis mode with deportation officers so overworked that they often lose track of dangerous illegal aliens with serious criminal histories, the probe found. This includes individuals who represent critical national security threats. One ICE agent cited in the report said this: “You might work 18 hours a day, but you still won’t get caught up.” Inspectors visited four key field offices and determined that the management deficiencies and unresolved obstacles make it difficult for the feds to deport aliens expeditiously. 
“ICE is almost certainly not deporting all the aliens who could be deported and will likely not be able to keep up with growing numbers of deportable aliens,” the DHS watchdog found.
The attack on ICE is another front to eliminate borders by the radical Left and its political allies. No government agency should be immune from closing but if the goal of closing an agency is to destroy the rule of law and our sovereignty then we should proceed with extreme caution.

Asylum Interview and Application Tips & FAQs from a Former Asylum Corps Officer
On Monday, June 4, 2018, Ethan Taubes, a former asylum officer at the Newark Asylum Office, spoke to RIF Asylum Support community members about the asylum process, the Asylum Corps, preparing the asylum application, and the asylum interview. Mr. Taubes also answered general questions from audience members after his talk. Read our earlier blog post, Former Asylum Officer Ethan Taubes speaks to community members at RIF Asylum Support. Here are some pointers and FAQs we've taken from Mr. Taubes's presentation.
Asylum Interview and Application Tips
Submit a complete asylum application. There are three essential elements that an applicant needs to submit when applying for asylum: (i) application form; (ii) statement; and (iii) supporting documentation for your claim. Submitting all of these together will help an officer verify your story and determine your credibility. The statement must explain your asylum claim and help the officer understand how you qualify for asylum. It is important to provide an explanation of any issues that an officer may wonder about. If possible, explain how and when you got the documents you are submitting and the reasons why you are submitting the documents.
Provide relevant documentation to prove your claim. Asylum officers conduct background research and have access to the most current country conditions reports. Do not include documents that give no value to the application. Provide documents that are personal to you as the applicant. Provide articles mentioning you by name, if those are available and support your claim. Submit targeted news articles that corroborate your story. Include documents that support or corroborate your claim, such as medical records and photos that show your injuries. Submit documents that are accurate and genuine, however, fraudulent documents may be submitted, with an explanation of its purpose, if it supports your claim. 
All documents in a foreign-language must have a certified English translation. It is very important that when submitting documents that are not in English, that it has a corresponding certified English translation by someone who is fluent in English and the foreign language. 
Submit additional documentation or updated information well before the asylum interview. Asylum officers have many responsibilities. They conduct two interviews a day and have two days in advance to review a particular application. It is best to submit additional documents or updated information before the interview date to give the officer time to review the new documents before the interview.
Ask for necessary accommodations before the interview. The asylum applicant should be able to accurately and thoroughly convey their personal story and the reasons why they should be granted asylum. Asylum officers understand that a person's traumatic experience may cause them to have memory lapses, anxiety, and other psychological issues. If this is the case, notify the office before the interview so they can make special accommodations and explain why. For example, if you suffer from PTSD as a result of your experience in your home country, provide information about your condition (such as a psychological evaluation) to explain memory issues or inconsistencies. Another example is if you are a victim of domestic violence and prefer to have a female officer conduct the interview, then you may request this accommodation before the interview.
Do not lie. During the interview, if you do not understand the question, ask the officer to repeat the question. If you do not know the answer to a question, say you don't know. If you do not remember details, say you don't remember. It is important to be truthful all the way as lying will bar you from asylum or other immigration relief. 
Prepare for your interview. The typical interview lasts two hours, so it is important that you conduct a dry-run of your interview. Review the asylum application and supporting documents you submitted beforehand. If you have an interpreter, make sure that you prepare with your interpreter. They are your mouthpiece, so they have to be familiar with the way you speak and be able to translate word-for-word. They must be confident in English and understand your dialect. You want someone to be able to stand up for you and speak on your behalf – fight for you.
FAQs 
What happens to applicants who are deemed not credible by the asylum officer? Two weeks after the interview, the applicant will receive a written decision about their case. If the officer determines that the applicant is not credible or there is not enough evidence to grant asylum, then the applicant's case will be referred to immigration court, for a second chance to prove their asylum eligibility in front of an immigration judge.
What happens to the applications that have been in the backlog (applications filed on 2016-2017)? How is the office handling the last in, first out (LIFO) policy? What is the rationale for the change? Did the asylum law change? According to the new last in, first out policy, applications in the backlog, including those filed before the institution of the new policy, will have to wait longer for their interviews to be scheduled. If there is an emergency, such as if there are family members whose lives are in danger, then the applicant can make an application to expedite directly with the asylum office. To deal with the backlog, refugee officers are helping asylum corps officers and the office has been ramping up the hiring of new officers. The reason for this change in policy is to deter frivolous claims and stem the increase in the backlog. This is merely a change in policy and the bases for applying for asylum remain the same and have not changed despite emerging trends in asylum adjudication.
When should an applicant apply for asylum? Is there a mandatory waiting period before an applicant can file for asylum? No. The decision when to file for asylum is for the applicant and their attorney/representative to make. There is a one-year filing deadline, but there are exceptions to this deadline. In some cases, it is recommended to apply before your status expires, but we do not recommend filing the application before you have all the necessary documentation to prove your claim. Typically, when you file an application, the U.S. Citizenship and Immigration Services (USCIS) has a stake in your case, so they would want to see that your case is resolved and you will not become a deportation priority.
Can you amend or modify your application after you submit it? Yes. If you have additional or updated documentation, please submit it before your interview (see tip above). At the beginning of the interview, the officer will ask you if all the information you provided so far is true and accurate. If this is not the case, then this is an opportunity for you to make the necessary corrections.
What happens if the country conditions have changed while your asylum application is pending? It depends. A change in country conditions does not necessarily mean that the person is no longer in danger if he were returned to the country. In certain cases, the applicant has undergone so much persecution in the past that it would be unconscionable to send him back. This is a case-by-case analysis and it is up to the applicant to show reasons why they should not be sent back despite the change in country conditions.
If you have a family member that has submitted an application in the past and you file on your own, is there a connection made because of the relationship? Not generally. Asylum applications are confidential and personal. The officer is not allowed to use other applicants' testimony unless they give a waiver of confidentiality (e.g. "You may use my brother's testimony for my asylum application, and he agrees to waive his right to confidentiality in order for you to do so").
Do family members have to be in the United States to be included in the application? Yes, all applicants included in the application have to be in the U.S. and will have to undergo the interview, including spouses and children. They will be asked questions to determine whether there are issues that may exclude them from getting asylum (called "asylum bar questions"). Family members outside of the country can be added later after the principal applicant is granted asylum in the U.S.
Is it imperative to have an interpreter? Can your lawyer be your interpreter? What happens if the interpreter is incompetent? The asylum office will not provide interpreters so you must provide your own interpreter if you are not confident in the English language. Your lawyer can be your interpreter, but this means that she cannot serve as your lawyer at that time, since she has given up her role as a lawyer to become your interpreter. If the officer or monitor determines that your interpreter is incompetent, they will stop the interview and reschedule for another time, which may further delay the process and the 180-day clock for employment authorization purposes.
What is the role of the monitor? The monitor cannot act as your second interpreter. Their primary role is to intervene when there is an error in the translation and are there to help minimize potential credibility concerns. They are considered a safety net to make sure that the record is accurate and reliable.
What is the role of the lawyer? The lawyer has a very limited but important role in the asylum interview. Their major responsibilities are to serve as a witness and to rehabilitate the applicant if necessary. They make ask the applicant questions to help clarify and make a summation at the end of the interview. Generally, the officer runs the interview and decides on the lines of inquiry. The lawyer is there to make sure that the interview is professionally conducted by the officer and to serve as support for the applicant.
